Rape Charges Dismissed in Joliet Man's Case

Charges have been dismissed against a Joliet man who spent 17 months in the Will County jail for a sexual assault that DNA showed he did not commit.

Nakita Ulmer, 26, was arrested Oct. 15, 2009, and charged with home invasion, robbery, aggravated criminal sexual assault and aggravated criminal sexual abuse in connection with the attack of a 62-year-old Joliet woman, according to a story in the Joliet Herald News.

He was released from jail in March 2011 when a DNA expert said the evidence collected could not have belonged to Ulmer, the story said.

The Will County State's Attorney's Office attempted to later introduce new evidence showing that Ulmer had an erectile disfunction pill in possession at the time of his arrest, supporting the victim's claim that her attacker was having trouble maintaining an erection, the story said.

When the judge would not allow the new evidence, the issue was appealed to the appellate court, which agreed with the judge in a ruling issued Jan. 8, the story said.
